Real estate agents collect more sensitive data than almost any other small business. Income, credit history, family situation, where they want to live, what they can afford, when they need to move. Each client interaction generates data that requires careful handling.

A privacy policy is required for any real estate agent or broker website that collects visitor information. That includes IDX-enabled sites with property search, lead capture forms, valuation tools, and contact pages.

This is more sensitive than typical "marketing data" because it directly profiles a person's financial situation and life plans.

Real Estate-Specific Sections

IDX search data. "When you search for properties on our website, we collect your search criteria, viewed listings, and saved properties. We use this information to provide relevant property recommendations and to follow up with you about your home search. This data is not shared with property sellers or other agents."

Lead capture forms. "When you contact us through our website (forms, chat, valuation requests), we collect the information you provide and use it to respond to your inquiry and provide ongoing real estate services. By submitting a form, you consent to be contacted by us via email, phone, or text message."

Property valuation requests. "If you request a home valuation, we use your address and basic property information to estimate value. We may also use this information to follow up about listing your property. We do not sell this information to third parties."

Buyer/seller financial info. "During the buying or selling process, we may collect or receive sensitive financial information including pre-approval letters, proof of funds, and income documents. This information is shared only with relevant parties (lenders, title companies, the other side's agent) as needed to complete the transaction. We do not retain this information beyond the transaction's completion."

MLS and broker compliance. "Our website uses MLS data through an IDX feed in compliance with our local MLS rules. Property listings displayed on our site are sourced from the MLS and are subject to MLS terms. Listing data is not personal information about you."
